Why Employers Continue to Test for Marijuana (THCin the Workpkace

As marijuana laws continue to change across the United States, workplace safety remains a top priority for employers. Although many states allow medical or recreational marijuana, marijuana is still prohibited for employees performing safety-sensitive duties under U.S. Department of Transportation (DOT) regulations. According to the DOT Office of Drug & Alcohol Policy & Compliance (ODAPC), a medical marijuana card or physician recommendation is not a valid medical explanation for a positive DOT drug test.


The Substance Abuse and Mental Health Services Administration (SAMHSA) recommends comprehensive Drug-Free Workplace Programs that combine written policies, supervisor training, employee education, and drug testing to help reduce workplace accidents, improve productivity, lower absenteeism, and strengthen workplace safety. For employees who operate commercial vehicles, heavy equipment, pipelines, rail systems, aircraft, or other hazardous machinery, impairment from THC can affect reaction time, coordination, judgment, and decision-making, placing both employees and the public at risk.


The White House Office of National Drug Control Policy (ONDCP) continues to support prevention-focused workplace strategies that promote safer, healthier, and more productive work environments. Drug-Free Workplace and Drug-Free Alliance programs help employers reduce liability, strengthen compliance, and foster a culture of safety through education, prevention, and accountability.


Workplace drug testing is also becoming increasingly important as transportation, construction, manufacturing, and energy industries continue to grow. Industry research projects the global workplace drug testing market to expand at an estimated 5–7% compound annual growth rate (CAGR), driven by stronger safety regulations, increased employer liability concerns, and expanding infrastructure projects.


For HR professionals, Safety Managers, Fleet Managers, DERs, and Third-Party Administrators (TPAs), marijuana testing is more than a compliance requirement; it is a proactive investment in protecting employees, reducing risk, and maintaining a safe, productive, and compliant workplace.
